Terms and Conditions


Definitions

Tussie-Mussie - The company Tussie-Mussie
The Sheep Shop - A trading division of Tussie-Mussie
Cuddly Friends - A trading division of Tussie-Mussie
Bridal Craft  - A trading division of Tussie-Mussie
Sprint Internet - A trading division of Tussie-Mussie

The Customer - Anyone making a request to Tussie-Mussie.
Product - Goods / services Tussie-Mussie has to offer.
Contract - The contract between Tussie-Mussie and the sale of products.
Delivery agent - The appointed delivery service.

General

All orders / requests are accepted by Tussie-Mussie on these terms and conditions which supersede any otherterms appearing elsewhere, unless otherwise specifically agreed in writing on Tussie-Mussie documentationby the owner of Tussie-Mussie. These terms and conditions override and exclude any other terms stipulated orincorporated or referred to by the customer, whether in the order or during any negotiations or any course of dealingestablished between Tussie-Mussie and the customer, and constitute the entire understanding between Tussie-Mussieand the customer for the sale of products or services.All descriptions and illustrations contained in our advertising material or any price list or otherwise communicatedto the customer are intended merely to present a general idea of the product and nothing contained in anyof them shall form any part of the contract between Tussie-Mussie and the customer.

Samples

Samples are not issued free of charge.
All samples are made to order and are charged at retail cost, deducted from thefinal cost of any order placed.
All samples are issued on a sale or safe, reusable return basis. If the sample/sis/are not returned after 28 days, an invoice will be issued, payable within 7days. When returning samples, Tussie-Mussie recommends Royal Mail, recordeddelivery.
'Premium' samples must be paid for in advance. The customer will be advised ifthey have requested a 'premium' sample in advance.
Tussie-Mussie reserves the right to waiver or endorse the sample charge and anyfurther costs incurred when recovering the sample charge.

Prices

Prices quoted are inclusive of Value Added Tax and are exclusive of packing and carriage.

Delivery

Normal method of delivery is Royal Mail post or Special Delivery.
Other methods may be available on request.
Delivery will normally only be made to the customer's usual address as notified to Tussie-Mussie.

Inspection, Transit Delay and Non-delivery

The customer must inspect the products as soon as is reasonably practical after delivery and shall within 5working days of delivery give notice to Tussie-Mussie in detail of any defect in the products or of any other complaintwhich the customer may have in relation to the products. If the customer fails to give such notice, the productsshall be conclusively presumed to be in all respects in accordance with the contract and free from any defect whichwould be apparent on reasonable examination and the customer shall be deemed to have accepted the products accordingly.

In the event of incorrectly supplied products, no counter claim will beaccepted until the said incorrectly supplied products have been returned inaccordance with our returns policy.

Queries regarding shortages of products must be made within 10 working days of the dispatch date and must be accompaniedby the dispatch note. Queries regarding products invoiced but not delivered must be made within 10 working daysof invoice date and the invoice number must be quoted. The customer is advised to contact Tussie-Mussie if neitherthe products nor the invoice in respect of the products are received within 7 working days of the promised dispatchdate. Where guaranteed next day or same day delivery has been specified, all queries regarding shortages and non-deliveryof products must be made within 3 working days of the requested delivery date.

The customer must refuse parcels delivered to them in a damaged condition.
Risk of loss of or damage to the products shall pass to the appointed delivery agent as notified by the dispatch notification. Proof of appointment of the delivery agent will be advised on the invoice and dispatch notification.

On acceptance of the product for delivery by the delivery agent shall Tussie-Mussie not be responsible for the loss of or damage to the product.

In no circumstances shall Tussie-Mussie be liable to compensate the customer in damages or otherwise for non-deliveryor late delivery of the products or any of them for whatever reason or for any loss consequential or otherwisearising from non-delivery or late delivery.

Royal Mail has lost my order

If an order is shipped by us, using first class mail service with Royal Mail, and is lost in the post, the customer must wait 15 working days from the date of posting before claiming from us for the order.

Royal Mail stipulate that we wait this length of time and once we have shipped the order to you there is little we can do until this time has passed. Once it haspassed we then have to go through the process of claiming from Royal Mail and will liaise with you, ourcustomer, about this at each level.

Passing of Risk and Property

The property of the products shall not pass to the customer until all sums due have been paid.Risk of loss of or damage to the products shall pass to the customer at the time of delivery. The propertyin the products shall not pass to the customer until all sums due have been paid.

Liability

In no event shall any breach of contract on the part of Tussie-Mussie or tort (including negligence) or failureof any kind on the part of Tussie-Mussie or that of its employees or agents give rise to any liability for lossor damage arising from any cause whatsoever.

Payment

Stationery:
Payment in full with order or 50% deposit with order, remainder within 7 working days from delivery (Unless otherwise stated on any order form).
Soft Toys:
Payment in full with order.

Methods of payment: Cheque, PayPal, Postal order or cash (at own risk).
Cheques to be made payable to Tussie-Mussie.

All payments must be made without any set-off, deduction or counter-claim.

Reservation of title of goods

Title to the goods will remain with Tussie-Mussie until all sums owing are paid in full.

Order Cancellations

Stationery:
Cancellations, part cancellations or rescheduling of an order can only be accepted after prior negotiationand agreement to terms which will indemnify us against any expenses incurred. In the event of a part cancellation,we reserve the right to invoice for any difference in selling price applicable to the quantity dispatched up tothe time of cancellation.
Soft Toys:
Cancellations, part cancellations or rescheduling of an order can only be accepted after prior negotiationand agreement to terms which will indemnify us against any expenses incurred. In the event of a part cancellation,we reserve the right to invoice for any costs incurred up to including cancellation.

We reserve the right to cancel any order placed and cleared funds received after five days if, for what ever reason we areunable or hindered to dispatch the goods due to incorrect or incomplete delivery information.  In such an event a full refundwill be given.

Special Orders:
Cancellation of special orders will not be accepted.

Copyright

Tussie-Mussie have taken all reasonable steps in the course of our business to ensure that the products donot infringe any patent, design, trademark, copyright or any other rights of third parties but no guarantee inthis respect is given and Tussie-Mussie shall have no liability whatsoever in the event of any such infringementhowsoever arising.
Tussie-Mussie own full copyright in respect of all our products and promotional material and its reproduction inpart or whole is prohibited without the written permission from Tussie-Mussie.

Country of Origin

Unless otherwise confirmed, no product is to be taken as a representation of the source of origin, manufactureor production of the products or any part thereof.

Returns and Handling charge

No returns are permitted without Tussie-Mussie's prior consent having been obtained. Subject to Tussie-Mussie's prior consenthaving been obtained, Products must be returned to Tussie-Mussie in an unused condition(complete with tags, regarding soft toys) within 30 days ofinvoice date stating relevant invoice number in order for the customer to be eligible for any refund. If productpacking is unopened, a 10% handling charge will apply with a minimum charge of £2.00. A higher rate may belevied for products returned outside this period or in an opened but unused condition. Products accepted for returnwill be credited at invoice value and the appropriate handling charge applied. If invoice details are not quoted,the credit will be based upon the lowest sales price.
All products are returned at the customer's risk and Tussie-Mussie accepts no responsibility for any loss or damagethereto, or to items added to the products by the customer and sent with the products to Tussie-Mussie.
Products to be returned to Tussie-Mussie should be adequately packed and dispatched freight pre-paid, clearly labeled to the address we quote for return.

Should your parcel be returned to us by Royal Mail and they state that you did not collect the package from the sorting office, a £5 administration charge will be levied to cover the handling of this order.

Force Majeure

If Tussie-Mussie is hindered or prevented from performing any contract owing to any cause beyond the reasonablecontrol of Tussie-Mussie or by its inability to procure services, materials or articles required for the performanceof the contract except at enhanced prices, Tussie-Mussie may at its sole option delay the performance of, or cancelthe whole or part of the contract and Tussie-Mussie shall not be held responsible for such delay or cancellationor inability to deliver. In particular, although Tussie-Mussie will use all reasonable endeavors to deliver backorders by the date stated by Tussie-Mussie, Tussie-Mussie shall not be held responsible for any delay in the deliveryof, or inability to deliver such orders.

Choice of Law

All contracts between Tussie-Mussie and the customer shall be governed by and interpreted in accordance withEnglish Law and the customer submits to the jurisdiction of the High Court of justice in England but Tussie-Mussiemay enforce any such contract in any court of competent jurisdiction.
